Court dismisses GEOSPAN claim against Pictometry

ROCHESTER, NY – September 10, 2008 – Pictometry International Corp., a leading provider of geo-referenced aerial image libraries whose patented and proprietary technology is used globally to capture oblique image libraries, announces that a declaratory action filed by GEOSPAN Corporation against Pictometry earlier this year has been dismissed by the U.S. District Court of Minnesota.

Citing a lack of subject matter jurisdiction, the District Court’s decision to dismiss GEOSPAN’s claim was among the first judgment of its kind to reference lowered declaratory judgment standards as defined recently by the U.S. Supreme Court.

“Pictometry is always proud and prepared to defend our proprietary technology,” said Pictometry President and CEO Richard Kaplan, adding, “in this case, we were especially steadfast in our belief that the court would make a meritorious decision in our favor once the facts were presented.”

GEOSPAN filed the declaratory action earlier this year following a business inquiry by Pictometry into GEOSPAN’s technology and its relation to Pictometry’s patent.

“Our inquiry was met with a surprisingly adversarial reaction, despite the fact that our patent considerably pre-dates theirs,” said Kaplan. “We are pleased that the judge’s dismissal of these unwarranted claims is consistent with our company’s position.”
