The Court also heard testimony regarding CSi's assertion that Ashlar's license to use CSi software in products marketed by Ashlar has terminated. Ashlar's president confirmed that Ashlar purposefully decided not to pay the fees necessary to maintain the license, that Ashlar received notice of its failure to pay, and that Ashlar did not fix this default within the period necessary to avoid termination of the license.
